"The California Secretary of State was expected to appeal the order by the 9th U.S. Circuit Court of Appeals immediately to the U.S. Supreme Court, and recall supporters said they had little doubt that the election would be held as scheduled."

"'...Forty-four percent of the electorate will be forced to use a voting system so flawed that the Secretary of State has officially deemed it 'unacceptable' and banned its use in all future elections,' the opinion noted. So, here's what I want to know, does Kevin Shelley really have to appeal something that is really not in his, the State, and the State's voters' best interests? Not to mention the interests of democracy, sorry, Democracy.

And, actually, the way things are now, I think the recall would be defeated on October 7 as well as in March 2004, so hey!
