"The recording industry can still bring civil lawsuits against people who download music illegally, but Friday's court ruling will make that more expensive and time-consuming.

"A federal appeals court said Internet providers, such as Verizon, EarthLink and America Online, do not have to turn over the names of their customers when music companies serve them with a subpoena.

"Individual judges could also opt to allow defendants to respond to the claim without revealing their identity to the recording industry, said Jonathan Zittrain, co-director of the Berkman Center for Internet and Society at Harvard Law School.

Because the John Doe approach requires that a lawsuit be filed, the recording industry would lose the ability to threaten legal action without having to actually sue anyone.

"'This is certainly a setback for the industry if they're looking to threaten without suing,' Zittrain said. 'It raises the stakes all around.'"
